Supreme Court Rules that Discrimination Based on LGBTQ+ Status Violates Title VII of the Civil Rights Act

Title VII of the Civil Rights Act of 1964 is a federal law that protects employees from discrimination “based on sex”.  Before today, a majority of courts held that discrimination based on sexual orientation was not sex-based discrimination.  As such, homosexual and transgender employees were not protected from workplace harassment and/or discrimination.  On June 15, 2020, the Supreme Court of the United States issued a monumental 6-3 opinion in Bostock v. Clayton County, Georgia, holding that discrimination against an employee for being gay or transgender is discrimination “based on “sex”, stating that “it is impossible to discriminate against a person for being homosexual or transgender without discriminating against that individual based on sex.”
